Making Peace through Mediation 

In New Jersey and coming soon North Carolina, divorce mediation or family mediation can be instrumental in assisting both parties in reaching an amicable agreement when it comes to family and matrimonial issues without going through the steps of traditional New Jersey divorce litigation.

  • Mediation is much less expensive than a court trial or a series of hearings. Average attorney costs for a divorce with kids and attorneys in NJ is $23.4K 

  • That is $46.8 per couple, NJ very rarely will a Judge order attorney fees. This money will normally come out of the martial assets, when all is said and  done.

  • Most Mediations end in a settlement of all of the issues in your divorce

  • We do not charge a retainer fee, we charge hourly.  Mediation can be as long or short, as you make it.  Giving you full control over the fees.  After mediation you have the paperwork that your attorney needs to file for the divorce. 

  • The Mediator is working for BOTH parties to help settle the estate and get the property settle agreement complete so the divorce can move forward.  

  • Mediation allows you to arrive at a resolution based on your own ideas of  what is fair in your families situation, rather that having a solution imposed upon you based on rigid and impersonal legal principles and standards.

  • You can still have a lawyer to give you legal advice if you wish.

  • You and your spouse, not the court can control the processes.

  • The mediation process can improve communication between you and your spouse, helping you avoid future conflicts.  This is better for your children, the goal moving forward is to come up with a working relationship for  everyone

  • Mediation is a faster process.  In NJ, a mediated divorce can be done in 6 months where with attorneys, the average divorce takes 21 months.

  • In a normal contested divorce in NJ, a Judge will normally order couples to seek mediation before rendering a Judicial discussion. This is after you have both spent countless dollars in attorney fees and waited months to get on the  court docket, to see the Judge.  It is recommend to see a mediator first and if differences can not be resolved, State required documentation will be provided to the court stating that you did try this course first.    

  •   Mediation is not all or nothing.  Divorce is a hard and emotional process and we understand sometimes there are things that can not be agreed on but with mediation we can document what is agreed on and easily streamline what your attorneys needs to work on, based on your situation. The more that can be agreed on in mediation, is less that has to be battled out with expensive attorneys and extra court dates.
